CONWAY PHARMACIST SURRENDERS LICENSE

A CONWAY PHARMACIST WHO HAD HIS LICENSE SUSPENDED IN OCTOBER 2013 AFTER HE ALLEGEDLY ADMITTED TAKING CONTROLLED DRUGS FROM A REHABILITATION CENTER IN EFFINGHAM HAS SURRENDERED HIS LICENSE TO PRACTICE PHARMACY.

THE NEW HAMPSHIRE BOARD OF PHARMACY’S EXEC. SECRETARY AND DIRECTOR JAY QUEENAN RELEASED A STATEMENT SIGNED BY JAMES T. NIXON SAYING “RECOGNIZING THAT PROFESSIONAL MISCONDUCT ALLEGATIONS ARE NOW PENDING AGAINST ME… I HEREBY VOLUNTARILY SURRENDER MY NEW HAMPSHIRE LICENSE…”

NIXON DOES NOT ADMIT TO VIOLATING THE LAW BUT HE DOES SAY “I ADMIT THAT THIS LICENSE SURRENDER HAS OCCURRED IN SETTLEMENT OF PENDING DISCIPLINARY CHARGES CONCERNING ALLEGATIONS THAT I DIVERTED CONTROLLED SUBSTANCES FROM MY EMPLOYER PHARMACY FOR PERSONAL USE.”

THE BOARD SUSPENDED NIXON’S LICENSE TO PRACTICE AFTER IT LEARNED HE WAS IN A CAR CRASH IN HOLLIS, MAINE OCT. 20, 2013 WHERE AN INVESTIGATING MAINE STATE TROOPER ALLEGEDLY FOUND MORE THAN 200 PRESCRIPTION PILLS IN HIS CAR. NIXON ALLEGEDLY TOLD AUTHORITIES HE HAD BEEN TAKING THE CONTROLLED DRUGS FOR HIS PERSONAL USE OVER A FOUR TO FIVE MONTH PERIOD FROM LAKEVIEW NEUROREHABILITATION CENTER IN EFFINGHAM, WHERE HE WAS THE PHARMICIST IN CHARGE.

LAKEVIEW ADMINISTRATOR DAVID ARMSTRONG SAYS AS A RESULT OF THE INVESTIGATION NIXON WAS PUT ON LEAVE AND HAS SINCE RESIGNED. ARMSTRONG SAYS LAKEVIEW HAS COOPERATED – AND WILL CONTINUE TO COOPERATE – WITH AUTHORITIES IN THEIR INVESTIGATION AND HE’S CONFIDENT NO PATIENTS HAD THEIR MEDICATION WITHHELD OR ALTERED – AND THEIR HEALTH AND SAFETY WAS NOT COMPROMISED. HE SAYS HIS FACILITY IS REVIEWING PROCEDURES TO MAKE SURE A SIMILAR INCIDENT DOESN’T HAPPEN AGAIN.

NIXON IS CHARGED WITH FELONY POSSESSION OF CONTROLLED DRUGS.
