CONWAY PHARMACIST SUSPENDED, CHARGED

THE NEW HAMPSHIRE BOARD OF PHARMACY HAS SUSPENDED THE LICENSE OF A LONG-TIME PHARMACIST FROM CONWAY. NEW HAMPSHIRE ASSt. ATTORNEY GENERAL MATTHEW MAVROGEORGE OF THE CONSUMER PROTECTION AND ANTI-TRUST BUREAU SAYS THE ACTION COMES AFTER JAMES T. NIXON WAS IN A CAR CRASH IN MAINE OCT. 20 2013 WHERE MORE THAN 200 PRESCRIPTION PILLS WERE ALLEGEDLY DISCOVERED IN HIS CAR.

NIXON ALLEGEDLY ADMITTED TO AUTHORITIES HE HAD BEEN TAKING THE CONTROLLED DRUGS FOR HIS PERSONAL USE OVER A 4 TO 5 MONTH PERIOD FROM LAKEVIEW NEUROREHABILITATION CENTER IN EFFINGHAM, WHERE HE WAS THE PHARMICIST-IN-CHARGE.

IN RESPONSE TO THE ALLEGATIONS, LAKEVIEW ADMINISTRATOR DAVID ARMSTRONG PROVIDED A WRITTEN STATEMENT SAYING HIS FACILITY IMMEDIATELY PUT NIXON ON ADMINISTRATIVE LEAVE AFTER LEARNING HE WAS UNDER INVESTIGATION AND NIXON HAS SINCE RESIGNED. ARMSTRONG SAYS LAKEVIEW HAS COOPERATED – AND WILL CONTINUE TO COOPERATE – WITH AUTHORITIES IN THE INVESTIGATION AND HE’S CONFIDENT NO PATIENTS HAD THEIR MEDICATION WITHHELD OR ALTERED AND THEIR HEALTH AND SAFETY WAS NOT COMPROMISED. HE SAYS LAKEVIEW IS REVIEWING ITS PROCEDURES TO MAKE SURE A SIMILAR INCIDENT DOESN’T HAPPEN AGAIN.

THE BOARD OF PHARMACY ISSUED AN ORDER OF EMERGENCY LICENSE SUSPENSION OF NIXON TUESDAY, SAYING IT HAD GOTTEN INFORMATION “INDICATING… THE CONTINUED PRACTICE OF PHARMACY BY HIM (NIXON, REFERRED TO AS “THE RESPONDENT”) POSES AN IMMINENT THREAT TO LIFE, SAFETY AND/OR HEALTH, WHICH WARRANTS THE TEMPORARY SUSPENSION….”

THE BOARD ALLEGES NIXON CRASHED HIS VEHICLE INTO A UTILITY POLE IN HOLLIS MAINE AND THEN TOLD THE INVESTIGATING MAINE STATE TROOPER HE BECAME SLIGHTLY DIZZY BEFORE HE CRASHED. THE TROOPER ALLEGEDLY OBSERVED MULTIPLE TYPES OF PILLS ON THE SEAT AND FLOORBOARD OF NIXON’S CAR, IN A DUFFEL BAG, AN EYEGLASS CASE AND IN A FOLDING CONTAINER.

THE BOARD FURTHER ALLEGES NIXON CONFESSED OCT. 26 2013) TO DRUG ENFORCEMENT AGENTS THAT HE BECAME ADDICTED TO THE CONTROLLED DRUGS – INCLUDING VICODIN AND MORPHINE – AFTER TAKING THEM FROM LAKEVIEW’S PHARMACY. AUTHORITIES SAY THEY HAVE SURVEILLANCE VIDEO ALLEGEDLY SHOWING NIXON AT WORK PUTTING PILLS IN HIS MOUTH.

NIXON IS CHARGED WITH FELONY POSSESSION OF CONTROLLED DRUGS. CHARGES OF DRIVING UNDER THE INFLUENCE OF DRUGS AND RECKLESS CONDUCT ARE PENDING. HE HAS BEEN ORDERED TO ATTEND A HEARING BEFORE THE PHARMACY BOARD NOV. 6, 2013 IN CONCORD TO DETERMINE IF HIS CONDUCT WAS UNPROFESSIONAL. NIXON WAS ISSUED A LICENSE IN NEW HAMPSHIRE AS A PHARMACIST IN OCTOBER OF 1982. THE BOARD CAN CONTINUE HIS SUSPENSION AND IMPOSE OTHER SANCTIONS ON HIM.
