THE CARROLL COUNTY ATTORNEY SAYS THE 33-YEAR-OLD MOTHER OF THE ABUSED CHILDREN IN THE JUSTIN ROY CASE HAS BEEN SENTENCED TO SERVE A YEAR IN THE CARROLL COUNTY JAIL.

ROBIN GORDON SAYS HEATHER DOWNS WAS SENTENCED BY A SUPERIOR COURT JUDGE IN OSSIPEE MONDAY AFTER PLEADING GUILTY TO ONE FELONY CHARGE OF WITNESS TAMPERING – FOR TELLING HER 9-YEAR-OLD CHILD NOT TO TALK TO THE POLICE – AND ONE MISDEMEANOR CHARGE OF ENDANGERING THE WELFARE OF A CHILD, FOR NOT BRINGING HER 2-YEAR-OLD BOY TO THE HOSPITAL IN A TIMELY MANNER.

THE CHARGES RELATE TO THE ROY CASE. ROY – WHO IS 34 – WAS LIVING AT A PARK IN ALBANY WITH DOWNS IN LATE 2011. HE WAS SENTENCED APRIL 2, 2013 TO A MINIMUM OF 22 AND A HALF YEARS IN THE NEW HAMPSHIRE STATE PRISON AFTER BEING CONVICTED ON SEVEN CHARGES IN CONNECTION WITH THE BEATING OF THE 2-YEAR-OLD THAT LEFT THE CHILD WITH LIFE THREATENING INJURIES.

THE JURY FOUND ROY INFLICTED BLUNT FORCE TRAUMA ON THE CHILD IN AN OUTDOOR SHED.

THE CHILD WAS IMMEDIATELY HOSPITALIZED ONCE AUTHORITIES DISCOVERED THE CIRCUMSTANCES OF THE CASE – AND HE HAS SINCE RECOVERED.

GORDON SAYS DOWNS – WHO IS NOW PREGNANT – HAS BEEN ORDERED TO BEGIN SERVING HER SENTENCE TWO WEEKS AFTER HER BABY IS BORN. SHE WILL ALSO BE ON PROBATION FOR TWO YEARS AFTER SHE IS RELEASED AND WILL HAVE A YEAR OF THAT SUSPENDED IS SHE COMPLETES PARENTING CLASSES.

DOWNS’ RELATIVES WILL TAKE CARE OF HER CHILDREN WHILE SHE IS INCARCERATED.
