MOULTONBOROUGH CONSIDERS REMOVING P-BOARD MEMBERS

TOWN LEADERS IN MOULTONBOROUGH WILL HOLD PUBLIC HEARINGS IN SEPTEMBER TO DETERMINE IF THERE’S CAUSE TO REMOVE TWO MEMBERS OF THE TOWN’S PLANNING BOARD.

THE BOARD OF SELECTMEN WILL HOLD TWO SEPARATE PUBLIC MEETINGS AT THE TOWN HALL ON HOLLAND ST. – THE FIRST STARTING AT 1 P.M. MONDAY SEPTEMBER 9, 2013 – TO CONSIDER IF THERE IS CAUSE TO REMOVE JOSIAH BARTLETT AND JUDITH RYERSON FOR REASONS OF “INEFFICIENCY, NEGLECT OF DUTY OR MALFEASANCE IN OFFICE.”

IN LETTERS DATED AUG. 8, 2013 AND MADE PUBLIC BY THE TOWN, BARTLETT AND RYERSON ARE INFORMED OF THE PUBLIC HEARINGS AND MATTERS THAT WILL BE CONSIDERED.

IN BARTLETT’S CASE, THE BOARD WILL HEAR PRESENTATIONS ON WHETHER HE FAILED TO ACT PROPERLY IN CONSIDERING A CONDITIONAL USE PERMIT A LIMITED LIABILITY COMPANY HAD APPLIED FOR – WHETHER HE FAILED TO APPLY REQUIRED CRITERIA AND WHETHER HIS ACTIONS CAUSED THE APPLICANTS TO FEAR THEIR REQUEST WOULD NOT GET A FAIR AND REASONABLE REVIEW – AND WHETHER HIS ACTIONS CREATED SUBSTANTIAL LEGAL RISK TO THE TOWN.

IN RYERSON’S CASE, THE BOARD WILL HEAR PRESENTATIONS ON WHETHER SHE DID NOT APPLY REQUIRED CRITERIA BY CHANGING HER VOTE WITHOUT FOUNDATION, WHETHER SHE NEGLECTED HER DUTY BY NOT ATTENDING EIGHT OF 12 PLANNING BOARD MEETINGS IN 2013 AND IF HER ACTIONS CREATED SUBSTANTIAL LEGAL RISK TO THE TOWN.

SELECTMEN WILL HEAR A HALF HOUR OF TESTIMONY AND QUESTIONS ABOUT THE REASONS FOR REMOVAL AND A HALF HOUR FOR REBUTTAL, BEFORE DELIBERATING.

THE LETTERS SENT BY SELECTMEN TO THE TWO PLANNING BOARD MEMBERS ARE AVAILABLE FOR VIEWING AT THE MOULTONBOROUGH TOWN OFFICE. THE NOTICE OF THE PUBLIC MEETINGS IS POSTED ON THE TOWN’S WEBSITE.
